1. Introduction
Welcome to TAPTIP (PTY) LTD ("TAPTIP (PTY) LTD", "we", "our", or "us"). These Terms & Conditions govern access to and use of the TAPTIP (PTY) LTD website, platform, and related services.
By accessing or using TAPTIP (PTY) LTD, you agree to these Terms. If you do not agree, you must not use the platform.
2. About TAPTIP (PTY) LTD
TAPTIP (PTY) LTD is a South African digital tipping platform that enables customers to make voluntary cashless tips to registered attendants.
Customers do not need to create an account to leave a tip. Registered attendants create accounts to receive tips, manage their profiles, and provide the information required for payouts.
TAPTIP (PTY) LTD provides the technology and platform used to facilitate digital tipping. TAPTIP (PTY) LTD is not the employer of an attendant solely because the attendant uses TAPTIP (PTY) LTD, and TAPTIP (PTY) LTD is not a party to any employment relationship between an attendant and a participating business.
3. How a Tip Works
- A customer scans or taps a TAPTIP (PTY) LTD-enabled identifier associated with an attendant.
- The customer selects the tip amount and confirms the intended recipient.
- The customer is directed to the applicable secure payment checkout.
- Once the payment provider confirms a successful payment, TAPTIP (PTY) LTD records the transaction and updates the relevant attendant's balance.
- The attendant's available balance may subsequently be paid out using a supported payout method, subject to verification, fraud checks, banking requirements, and the applicable payout schedule.
TAPTIP (PTY) LTD may change or improve this flow as the platform develops, provided that the applicable payment, security, and legal requirements continue to be met.
4. Eligibility
By using TAPTIP (PTY) LTD, you confirm that you are at least 18 years old, or have the necessary legal authority to use the platform, and that information you provide is accurate and complete.
5. Acceptable Use
You may use TAPTIP (PTY) LTD only for lawful purposes. You must not:
- use TAPTIP (PTY) LTD for fraudulent, deceptive, or illegal activity;
- attempt unauthorised access to our systems or accounts;
- interfere with platform security or availability;
- introduce malware or harmful code;
- misrepresent your identity or another person; or
- use TAPTIP (PTY) LTD in a way that creates an unreasonable security, legal, or operational risk.
We may suspend or restrict access where misuse or suspicious activity is reasonably suspected.
6. Customer Payments
Tips are voluntary payments selected and authorised by the customer. Customers are responsible for checking the recipient and amount before completing payment.
A payment is considered successfully completed when the payment provider confirms the transaction. A payment may be delayed, declined, reversed, refunded, or placed under review by the payment provider or financial institution.
7. Payment Processing
Yoco is the proposed payment provider. TAPTIP (PTY) LTD has not yet applied for or received approval, and real checkout remains closed. Where Yoco Checkout is enabled, TAPTIP (PTY) LTD's integration may create a checkout session and use payment-status notifications such as webhooks to record the outcome of a transaction.
TAPTIP (PTY) LTD does not store customers' full debit or credit card numbers on its own servers. Payment processing remains subject to the applicable payment provider's terms, security controls, fraud monitoring, and operating rules.
8. Attendant Accounts and Verification
Registered attendants are responsible for providing accurate information, maintaining current payout details, protecting their login credentials, and reporting unauthorised activity promptly.
TAPTIP (PTY) LTD may request identity, business, banking, or other verification information where reasonably necessary for security, fraud prevention, legal, regulatory, payment-provider, or payout requirements.
False, incomplete, or misleading information may result in suspension or removal from the platform.
9. Payouts
Attendant payouts are subject to successful payment collection, applicable verification requirements, fraud and security checks, payment-provider rules, banking requirements, and payout processing times.
TAPTIP (PTY) LTD may temporarily delay, restrict, or withhold a payout where reasonably necessary to investigate suspected fraud, security concerns, a disputed transaction, a payment reversal, or a legal or regulatory requirement.
Nothing in these Terms is intended to limit a customer's rights under applicable law or the rules of the relevant payment provider or card scheme.
10. Fees
The amount a customer chooses to tip is the amount charged. TAPTIP (PTY) LTD does not add any additional fee on top of a tip at checkout.
TAPTIP (PTY) LTD deducts a service fee of 10% from each tip before payout. The remaining 90% is allocated to the attendant. The fee and attendant amount are itemised before payment. For example, a R10 tip has a R1 service fee and R9 allocated to the attendant.
11. Refunds and Disputes
Because tips are voluntary payments, a completed tip is not automatically refundable. However, TAPTIP (PTY) LTD will review requests relating to duplicate payments, technical errors, unauthorised transactions, or other legitimate issues on a case-by-case basis.
Refunds and payment disputes remain subject to the applicable payment provider's processes, card-scheme rules, and South African law. Nothing in these Terms removes or limits any non-waivable cardholder or consumer rights.
12. Privacy and Personal Information
TAPTIP (PTY) LTD processes personal information in accordance with its Privacy Policy and POPIA Privacy Notice. We take reasonable technical and organisational measures to protect personal information.
13. Intellectual Property
All TAPTIP (PTY) LTD content, including logos, branding, graphics, icons, software, website design, text, images, videos, and source code, is owned by or licensed to TAPTIP (PTY) LTD and protected by applicable intellectual property laws.
You may not copy, reproduce, modify, distribute, or commercially exploit TAPTIP (PTY) LTD content without prior written permission, except where permitted by law.
14. Availability and Third-Party Services
We aim to keep TAPTIP (PTY) LTD available and reliable, but we do not guarantee uninterrupted access. The platform may be affected by maintenance, security updates, technical failures, internet outages, banking systems, payment providers, or other third-party services.
Third-party services, including payment providers and banking services, may have their own terms and privacy policies. TAPTIP (PTY) LTD is not responsible for matters outside its reasonable control.
15. Security
We take reasonable steps to protect TAPTIP (PTY) LTD and its users. Users are responsible for protecting their own devices, passwords, and account credentials and should report suspected security incidents promptly.
16. Limitation of Liability
To the fullest extent permitted by South African law, TAPTIP (PTY) LTD will not be liable for indirect or consequential loss, loss of profits, loss of business opportunity, data loss, or delays or interruptions caused by third-party providers or circumstances beyond our reasonable control.
Nothing in these Terms excludes or limits liability where doing so would be unlawful or would exclude a right that cannot legally be excluded.
17. Indemnity
To the extent permitted by law, you agree to indemnify TAPTIP (PTY) LTD against claims, losses, liabilities, costs, or expenses arising from your unlawful use of the platform, breach of these Terms, or infringement of another person's rights.
18. Suspension and Termination
TAPTIP (PTY) LTD may suspend, restrict, or terminate access where we reasonably believe that these Terms have been breached, fraudulent or unlawful activity has occurred, security is at risk, or continued access could expose TAPTIP (PTY) LTD or another party to legal or regulatory risk.
19. Changes to TAPTIP (PTY) LTD or These Terms
We may modify, improve, suspend, or discontinue features of TAPTIP (PTY) LTD from time to time. We may also update these Terms. The latest version will be published on this website with a revised "Last Updated" date. Continued use after an update becomes effective constitutes acceptance of the revised Terms to the extent permitted by law.
20. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from or relating to these Terms will be subject to the jurisdiction of the South African courts, subject to any mandatory rights or dispute-resolution processes that apply by law.
